Cost effective construction arbitrations
A presentation was given on 19 September at the American University in Dubai by Nigel Truscott, partner
at Al Suwaidi. Arbitration is something most commercial organisations would prefer to avoid. Given the complex nature of many building and civil engineering projects and that each is a unique prototype in a manufacturing sense, it is not surprising that claims and disputes regularly arise and that arbitration is necessary to resolve some of these disputes. Mr Truscott provided some very useful practical guidance
and tips on how once in arbitration the costs can be reduced and some aspects avoided. The event was
very popular. ICES UAE was represented by Dhammika Gamage, Syed Aslam, Ian Foulds and
Ivan Warnes.
Mock mediation
Peter Shaw, consultant solicitor with SNR Denton, gave a presentation on 3 October at Abu Dhabi Men’s College on the key aspects of mediation. Mr Shaw has a wealth of experience in this field and provided
some guidance on the key requirements for a successful mediation. This was followed by a mock
mediation which reached a successful conclusion after just over one hour, somewhat shorter than a mock arbitration would have taken. The different forms of alternative dispute resolution in the construction
industry are still developing in the Middle East, and culture and tradition present their own peculiar challenges. Encouraging parties to attempt mediation is one of the challenges the talk touched upon.
After a Q&A secession a poll of the audience was held as to whether or not they considered mediation
had a role in the Middle East. It was an almost equal split verdict. ICES UAE was represented by
Ian Foulds, Craig Troup and Ivan Warnes.
